BY-LAW 10
NATIONAL CONVENTIONS
Section (1)
The supreme
governing body of this Component, consistent with its area of jurisdiction as
provided by the Constitution of the Public Service Alliance of Canada, shall be
the Triennial National Convention.
Section (2)
The National
Convention of this Component shall be composed of accredited delegates from
Locals and the National Council Officers of this Component.
Section (3)
The Triennial
National Convention shall:
a) adopt rules of
procedures governing the processing of all matters before the National
Convention;
b) deal with all resolutions and matters
submitted to it by Locals and the National Council including resolutions and
matters to be passed on to the Triennial National Convention of the Public
Service Alliance of Canada. All such
resolutions shall be adopted at a Local meeting or a National Council meeting
to be held no later than 4 months before the opening of the Triennial National
Convention;
c) establish the
general policies of the Component between Triennial National Conventions;
d) elect from amongst its delegates, officers of the Component as outlined in Bylaw 6, Section (2) (b) and Bylaw 9, Section (8);
e) ratify all appointments to Committees of the Triennial National Convention made by the National Council or the National Executive;
f) establish the budgetary provisions of the ensuing period including the dues to be paid by each member other than those dues established by Locals or any other body of the Public Service Alliance of Canada;
g) review all reports submitted to it by officers and subordinate bodies;
h) act upon any other items of business placed before the duly-elected delegates in the manner prescribed by the procedural rules adopted by the Convention for the orderly processing of its business.
Section (4)
The date and location
of the Triennial National Convention shall be decided by the National Council
with such decision transmitted to the Locals not later than six months prior to
the opening date of such Convention. The
Triennial National Convention shall be held at a date consistent with the
provisions of Sub-section (4), Section 9 of the Constitution of the Public
Service Alliance of Canada. Such convention call to include final date for receipt of
resolutions from Locals.
Section (5)
Each accredited
delegate present at National Convention shall be entitled to one vote on each
subject and proxy votes shall not be permitted.
Section (6)
At least three
months prior to the opening date of a Triennial National Convention, the
National Council shall appoint from amongst accredited delegates such
committees as may be necessary for the conduct of the business of the
Convention. Delegates shall be advised
of their committee assignment by the National President at least two months
prior to the opening of the Convention and shall be supplied with an official
copy of the agenda proposed by the National Council.
Section (7)
All Locals
shall have the right to send observers to National Conventions at Local
expense. Observers shall not have the
right to vote or to participate in debate at National Convention.
Section (8)
A special
National Convention shall be held at the request of the National Council
provided that two-thirds of the National Council vote
in favour. Such
special convention to be held at a time to be decided by the National Council.
Section (9)
Special
National Conventions shall be composed of delegates elected by Locals in
accordance with Section (11) of this By-Law and the numerical table specified.
Section (10)
A Special
National Convention of this Component shall deal with only the matter or
matters for which it was called, unless such Special Convention agrees, by a
two-thirds majority vote of its assembled delegates, to consider other matters
of an urgent or necessary nature within the time limits set for such Special
National Convention.
Section (11), Sub-Section (a)
At least four
months prior to the opening date of the Triennial National Convention, each
Local shall elect, from amongst its members at a general meeting of the Local,
accredited delegates to the Convention of this Component on the basis of the
following table established six months prior to the opening of the Convention:
20 to 125 members - 1 delegate
126 to 250 members - 2 delegates
251 to 400
members - 3 delegates
401 to 550
members - 4 delegates
551 to 700
members - 5 delegates
701 to 850
members - 6 delegates
851 to 1000
members - 7 delegates
1001 to 1150
members - 8 delegates
1151 to 1300
members - 9 delegates
1301 to 1450
members - 10 delegates
1451 to 1600
members - 11 delegates
1601 to 1750
members - 12 delegates
1751 to 1900
members - 13 delegates
1901 to 2050 members - 14 delegates,
etc.
Section (11), Sub-section (b)
The National
Council shall have the right to grant delegate status to one representative
from any Local with less than twenty (20) members, provided said Local has
submitted a request in writing no less than four (4) months prior to the
opening date of the Triennial Convention.
The decision of the National Council shall be final and shall require a
two-thirds (2/3) majority for approval.
Section (12)
Immediately
following the election of Local delegates to the National Convention, the Local
secretary shall submit to the Assistant to the President the names of the
Local's accredited delegates on a credential form supplied by the National
Office of this Component.
Section (13)
NRU delegates
to the Triennial National Convention of the Public Service Alliance of Canada
shall be the First National Vice-President, the Second National Vice-President
and the balance of the Component delegate entitlement as established by the
Constitution of the PSAC, shall be elected from
amongst those delegates present at the Triennial National Convention of the
Component.
Section (14)
Supplementary
resolutions to a Triennial National Convention shall be submitted to the
Assistant to the President 48 hours prior to the opening date of said
convention and, such supplementary resolutions shall be the last order of
business unless otherwise decided by a two-thirds majority of the delegates
voting in convention.
Section (15)
A member shall
be nominated as a Delegate or Alternate only if he/she has attended at least
50% of their local's Membership Meetings for which they are eligible to attend
during the period between conventions ending with the Local meeting at which
the convention delegates are elected or if he/she is elected to a Local
Executive position during the convention year.
