BY-LAW 6
NATIONAL
Section (1)
The National
Council shall be composed of the National Executive as per By-Law 6, Section
(2) (a) and the National Directors as per By-Law 6, Section (3).
Section (2)
(a) The National Executive shall be composed
of the National President, the First National Vice-President, the Second
National Vice-President and the Assistant to the President.
(b) The National President, First National
Vice-President and Second National Vice-President shall be nominated and
elected at each regular triennial national convention of the Component by the
voting delegates attending such convention.
(c) Where a vacancy occurs in the National
Executive more than six (6) months prior to the NRU National Triennial Convention;
and where such vacancy cannot be filled through the normal order of ascension,
nominations shall be called by the National Executive from amongst the
delegates to the last National Convention still in good standing in the Natural
Resources Union. A period of not more
than 30 days from the date of notice of the vacancy shall elapse and the
National Executive shall ensure that the nominees are members in good standing,
who were delegates to the last National Convention and are prepared to stand
for office. If an election is necessary,
the delegates from the last National Convention then shall elect a successor
from amongst the eligible nominees within a period of 30 days from the close of
nominations.
Section (3)
National Directors:
Presidents of
Locals with a membership of 20 to 500 members shall automatically be National
Directors. Locals with 501 or more
members shall elect additional National Directors according to the following
formula:
20 to 500 the
Local President or elected alternate
501 to 1000 one
additional National Director
1001 to 1500 two
additional National Directors
1501 to 2000 three
additional National Directors
2001 to 2500 four
additional National Directors, etc.
Election of
additional National Directors to be held according to Local regulations. Elected National Director(s) name(s) to be
forwarded to the National President no later than 60 days after the adjournment
of the convention. In the event of
relocation of members to other areas, if sufficient number of members warrant
the formation of a Local, the above formula will apply. Locals losing said members will not have to
make adjustments according to the above formula unless one or more directors of
the above Local leave the said Local.
Section (4)
An Assistant to
the President shall be employed by the National Executive. The incumbent shall attend all meetings of
the National Executive and the National Council during his/her tenure with
voice but no vote.
Section (5)
(a) All
members of the National Executive, excepting the Assistant to the President
shall be members in good standing of this Component.
(b) The
National President shall act on a full-time basis.
Section (6)
(a) A quorum
of the National Executive shall be the National President, one other elected member
of the National Executive and one other member of the National Executive.
(b) In the
absence of the National President, the First National Vice-President, Second
National Vice-President and one other member of the National Executive shall
constitute a quorum.
(c) A quorum
of the National Council shall be the President, or in his/her absence, the
First National Vice-President and the majority of other members of the National
Council.
Section (7)
(a)
The National Executive shall meet at least twice annually
at the call of the President or at any other time if requested by a majority of
the National Executive.
(b) The
National Council shall hold meetings annually at the call of the National
President or at any other time if requested by the majority of the members of
the National Council.
(c) Accurate
minutes of all meetings and conference calls of the National Executive be kept
by the Assistant to the President including a record of all substantive votes
and that a copy of these minutes be distributed to the National Council within
sixty (60) days after the meeting.
Section (8)
Between
Conventions, all Executive powers of the Component, consistent with these
By-Laws shall be vested in the National Council.
Section (9)
The National
Council shall have the power to make such regulations as are necessary for the
proper conduct of the business of this Component, provided such regulations do
not conflict with the provisions of these By-Laws. Such regulations shall be made available
within 60 days of their adoption by the National Council and shall be
subsequently subject to ratification by a National Convention of this
Component.
Section (10)
The National
Executive shall have the authority to hire or dismiss national office employees
of this Component. All rights,
privileges, work standards and remuneration shall be similar to the conditions
of employment in the Public Service Alliance of Canada.
Section (11)
All actions by
the National Council on behalf of this Component between Conventions may be
subject to review at the next Triennial National Convention.
Section (12)
The National
Council shall be considered as being in business session throughout the period
of the National Convention, and its elected members shall have all rights and
privileges due to National Convention delegates.
Section (13)
The National
Council shall submit a year-to-year budget for the ensuing three-year period
for approval to each Triennial National Convention.
Section (14)
The National
Council shall have the authority to establish any committee necessary for the
conduct of the affairs of this Component.
The National President shall be ex officio a member of any committee so
formed.
